Final ruling delivered by Court of Appeal

Nairobi, Kenya – I am pleased to announce the final ruling related to two Civil Application cases – the first filed by the Kenya Revenue Authority (KRA), the second jointly filed by the Inspector General of Police, the Attorney General, and the Directorate of Criminal Investigations – was delivered on June 22, 2023.

The Court of Appeal determined that both applications failed to meet the required threshold and subsequently dismissed them. No appeals were filed by the concerned parties following the Notices of Appeal deadline.

Below is a timeline of legal events:

  • On May 23, 2022, the High Court of Kenya made a decision in Criminal Case No. 1333 of 2019 Republic vs Humphrey Kariuki and others, ruling that certain actions by the Kenyan authorities were unconstitutional.
  • In response to this decision, several parties, including the Kenya Revenue Authority (KRA), the Inspector General of the National Police Service, the Attorney General, and the Directorate of Criminal Investigations, filed Notices of Appeal, signalling their intention to challenge the ruling.
  • Subsequently, KRA filed Civil Application No. 187 of 2022 seeking to suspend the execution of a specific clause in the judgment pending the outcome of its appeal. Additionally, the Inspector General of Police, the Attorney General, and the Directorate of Criminal Investigations jointly filed Civil Application No. E188 of 2022 seeking conservatory orders to stay the execution of the judgment.
  • On June 22, 2022, the Court of Appeal granted an interim stay of execution of the judgment, with certain exceptions noted for individuals involved in Criminal Case No. 1333 of 2019. This acknowledgment effectively brought an end to the criminal case against me.
  • I am pleased to announce that the final ruling on Civil Application No. 187 of 2022 and Civil Application No. 188 of 2022 was delivered on June 22, 2023. The Court of Appeal concluded that neither application met the necessary criteria and thus dismissed both of them.
